제1조 (목적)

This Statement of Terms of Use ("Terms of Use") identify what you, as a registered user of the Idea Card Site("you" or "user") can expect from Crevate Partners Co.("Company or We") and Idea Card website(www.openideacard.com)("Site") and what Company and Site in turn expect from Users.  By using or accessing IdeaCard website, you agree to be bound by this Statement.

본 서비스 약관(“본 약관”)은 아이디어카드 웹사이트에 가입한 사용자(이하 "회원")와 ㈜크리베이트파트너스(이하 “회사”) 및 ㈜크리베이트파트너스가 운영하는 아이디어카드 웹사이트(www.openideacard.com)(이하“사이트”) 간의 권리, 의무를 정하는 것을 목적으로 합니다. 아이디어카드 웹사이트를 이용하는 것은 귀하가 본 약관에 동의하였음을 의미합니다.

제2조 (Amendments)

We can revise this Statement in the range of not violating the Control Act on General Clause or related laws. The most current version will always be at www.openideacard.com/***. 

회사는 약관의 규제에 관한 법률 등 관련법을 위배하지 않는 범위에서 이 약관을 개정할 수 있습니다. 약관의 최근 버전은 www.openideacard.com/***에서 확인할 수 있습니다. 

제3조 (Definitions)

Where the following words appear they will have the following meanings.  

이 약관에서 사용되는 용어의 의미는 다음과 같습니다.

1. By "Member or You" we mean a person who has registered to the website with providing basic information. A member has a right to participate the Global Translation Project and translate the Idea Card. 

2. By "Non-member" we mean a person or an organization who use the website with registration. Non-member can use all the functions in the website except for participating the Global Translation Project. 

3. By "Site" we mean the Idea Card website(www.openideacard.com) that Crevate Partners co. operates. 

4. By "Content" we mean all the data including information, statements, graphics that are provided by "Site". 

5. By "Global Translation Project" we mean the activity of translating the Idea Cards which the Company provide in Korean, English and Japanese through the Site into another language. 

6. By "Translated content" we mean the content that is translated by "Member" who has participated in the Global Translation Project. 

1. 회원 : 사이트에 개인정보를 제공하여 회원등록을 한 개인. 글로벌 번역 프로젝트에 참여하여 아이디어카드를 번역할 수 있는 권한을 갖게 됩니다.

2. 비회원: 회원등록 없이 사이트를 이용하는 개인이나 단체. 글로벌 번역 프로젝트 참여를 제외한 사이트 내 모든 기능을 이용할 수 있습니다.

3. 사이트: ㈜크리베이트파트너스가 운영하는 아이디어카드 웹사이트(www.openideacard.com)

4. 콘텐츠: "사이트"를 통해 제공되는 정보, 문구, 그래픽 등의 모든 자료.

5. 글로벌 번역 프로젝트: 회원들이 사이트에서 한/영/일어로 제공되는 회사의 아이디어카드를 제 3의 언어로 자유롭게 번역하는 것.

6. 번역물: 글로벌 번역 프로젝트에 참여한 "회원"이 번역한 콘텐츠.  

제4조 (Privacy Policy) ***

1. You will keep your personal information up-to-date if there has been any changes after registration. We are not responsible to any harm that occurs from the personal information not updated.  

2. We will never provide any of your personal data to a third party without your permission, except for the case of ___________________.  

3. We designed our "Privacy Policy" and operate it to keep your privacy safe.   

1. 회원은 회원등록 시 기재한 개인정보가 변경되었을 경우 변경사항을 수정하여야 합니다. (수정하지 않은 정보로 인하여 발생하는 손해에 대하여 회사는 아무런 책임을 지지 않습니다. )

2. 회사는 법률에 특별한 규정이 있는 경우를 제외하고는 회원이 제공한 정보를 회원의 동의 없이 제3자에게 공개하거나 제공하지 않습니다. 

3. 회사는 회원의 개인정보를 보호하기 위해 "개인정보보호정책"을 수립하고 운영합니다.

제8조 (개인정보 취급 방침)  --> 꼭 필요한지 의논 요망. 4조와 중복됨.

회원이 사이트에 제공하는 정보 일체는 당사의 개인정보취급방침에 따르며, 당사가 귀하의 정보를 수집 및 이용하는 행위는 동 정책에 따라 규제될 수 있습니다.

 귀하는 본 서비스를 이용함으로써 회사가 저장, 처리 및 이용 목적상 해당 정보를 한국 및/또는 기타 국가로 전송하는 것을 비롯하여 당사가 회원의 정보를 수집 및 이용(개인정보취급방침에서 규정하는 바와 같음)하는 것에 동의하는 것으로 간주됩니다. 

또한 회원에게 본 서비스를 제공하는 것의 일환으로, 서비스 관련 공지사항 및 행정적 사안에 관한 메시지를 비롯한 전달사항을 제공할 필요가 있을 수 있습니다. 이러한 전달사항은 회원 가입 시 기입한 이메일과 사이트 내 공지사항을 통해 전달되며, 회원은 이를 수신거부 할 수 없습니다. 

제5조 (Password and Account Security) 아이디 및 비밀번호의 관리

1. You are responsible for maintaining the confidentiality of your account and password, 

2. You will not share your password, let anyone else access you account. 

3. You agree to accept responsibility for all activities that occur under your account or password.  

1. 회원은 아이디(ID) 및 비밀번호에 대한 관리책임이 있습니다. 

2. 회원은 아이디(ID) 및 비밀번호를 제3자가 이용하도록 제공하여서는 안됩니다. 

3. 해당 아이디(ID)와 비밀번호로 행해진 모든 행위에 대한 책임은 회원 본인에게 있습니다.

제6조 (회원의 해지)

1. You can ________ at anytime with _______________. But the translated contents you uploaded on the Site before termination will not be deleted. 

2. If you violate these terms, or otherwise act disrespectfully, disruptively or illegally on the "Site", we reserve the right to terminate your membership at any time without prior notice.  

1. 회원은 언제든지 회사에게 해지의사(회원탈퇴)를 통지함으로써 이용계약을 해지할 수 있습니다. 다만, 회원 해지 시 기존에 등록한 번역물은 삭제되지 않습니다.

2. 회사는 회원이 본 약관을 위반하거나 무례하고 분열을 일으키는 방식으로 불법적으로 행동한 경우 사전 통보 없이 회원 자격을 중지할 수 있습니다. 

제7조 (사이트의 변경과 중단)

We can change the "Site" and services without prior notice to the members. And the "Site" and services can be terminated at our sole discretion. 

본 사이트 및 제공되는 서비스는 언제든지 회원에 사전 통지 없이 변경될 수 있습니다. 또한 회사는 본 사이트 및 서비스의 제공을 재량에 따라 중단할 수 있습니다.

제9조 (회원의 번역물에 대한 소유) - -> TED open translation 약관 참고해서 변경/축소함..

회원이 작성한 번역물에 대한 권한은 회사에 있습니다. 회사는 번역물이 다음 각 호에 해당하는 경우 사전 통보 없이 해당 번역물을 삭제 하거나 회원에 대하여 특정 서비스의 이용제한 등의 조치를 할 수 있습니다.

1. 대한민국의 법령을 위반하는 내용을 포함하는 경우

2. 관계법령에 의거 판매가 금지된 불법제품 또는 음란물을 게시, 광고하는 경우

3. 허위 또는 과대광고의 내용을 포함하는 경우

4. 타인의 권리나 명예, 신용 기타 정당한 이익을 침해하는 경우

5. 정보통신기기의 오작동을 일으킬 수 있는 악성코드나 데이터를 포함하는 경우

7. 사회 공공질서나 미풍양속에 위배되는 경우

8. 회사가 제공하는 서비스의 원활한 진행을 방해하는 것으로 판단되는 경우

1. All Translations in the Site are covered by our Creative Commons license. You are free to share the Translations with friends, but this use must be made within the terms of the CC license "Attribution - NonCommercial - NonDerivative."  

3. We reserve the right to remove Translation alleged to be infringing without prior notice and at our sole discretion.  

1. 사이트에 게시된 모든 번역물은 크리에이티브 커먼스 라이센스(CCL)의 보호를 받습니다. 회원은 번역물을 다른 사람과 공유할 수 있지만, 이러한 활용은 CCL의 "저작자표시 - 비영리 - 변경금지" 조건에 따라야 합니다. 

2. 회사는 사이트에 게시된 번역물이 원본을 충실하게 반영하고 있지 않거나 허위 내용을 포함하는 경우, 이를 사전 통보 없이 삭제할 권한이 있습니다.  

제10조 Controlling law and Jurisdiction 관할법원 및 준거법 (to 식, 도와주세요!)

These Terms and any action related thereto will be governed by the laws of the Republic of South Korea. 

이 약관 및 기타 이용계약과 관련하여서는 대한민국의 법률을 준거법으로 합니다. 

Any dispute relating in any way to your visit to the "Site" or to translated "Contents" shall be ___________________________. 

회사와 회원 간 발생한 분쟁에 관한 소송은  (아래 3개 중 하나)

  - 회사의 본사 소재지의 관할법원에 제소합니다 / 회사의 본사 소재지를 관할하는 법원을 합의관할법원으로 정합니다. / 

  - 회사의 본사 소재지의 관할법원을 합의관할법원으로 정합니다

These Terms and any action related thereto will be governed by the laws of the State of California without regard to or application of its conflict of law provisions or your state or country of residence. All claims, legal proceedings or litigation arising in connection with the Services will be brought solely in San Francisco County, California, and you consent to the jurisdiction of and venue in such courts and waive any objection as to inconvenient forum. If you are accepting these Terms on behalf of a United States federal government entity that is legally unable to accept the controlling law, jurisdiction or venue clauses above, then those clauses do not apply to you but instead these Terms and any action related thereto will be will be governed by the laws of the United States of America (without reference to conflict of laws) and, in the absence of federal law and to the extent permitted under federal law, the laws of the State of California (excluding choice of law).

<아마존 참고>  Any dispute relating in any way to your visit to Amazon.com or to products or services sold or distributed by Amazon or through Amazon.com in which the aggregate total claim for relief sought on behalf of one or more parties exceeds $7,500 shall be adjudicated in any state or federal court in King County, Washington, and you consent to exclusive jurisdiction and venue in such courts.
